K18 FUTURE OF HAIR FEST – FEBRUARY 10 - 11, 2025

TERMS AND CONDITIONS

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. BY REGISTERING FOR THIS EVENT, YOU REPRESENT THAT YOU ACCEPT THESE TERMS AND CONDITIONS AND ARE AUTHORIZED TO DO SO.

  1. Event Registration. To register for the K18 Future of Hair Fest (“K18 Future of Hair Fest” or “Event”), you must complete the Event registration and pay any registration fees via this link: https://www.eventbrite.com/e/k18-future-of-hair-fest-tickets-952906487957. You must be at least 18 years old on the date of the Event. Event registration is subject to availability. All ticket sales are final and non-refundable, except as provided in Section 6 below. Tickets bear no cash value and are not redeemable for cash. K18 makes no representations or warranties as to the security of any information you might be requested to give, and is not responsible for any aspect of Eventbrite’s website, including purchases made on such website.

  1. Cooperation; Zero Tolerance Policy. Your attendance or participation at K18 Future of Hair Fest is subject to a zero tolerance policy regarding unauthorized drug use, firearms, and any type of behavior or actions that can be interpreted as lewd and obscene or disruptive, disorderly or uncivil. You agree to comply with all Event or venue rules, regulations, the aforementioned zero tolerance policy, and applicable law. You acknowledge and understand that you and your property may be subject to a reasonable search upon entry to the Event or the Event venue and that you may be asked to provide photo identification. If you are found in possession of prohibited items at K18 Future of Hair Fest or if you engage in any behavior or action that violates the zero tolerance policy, or any applicable rules, regulations or law, your participation in K18 Future of Hair Fest will be terminated immediately. This means that we or the venue may deny you entry to the Event and that we or the venue reserve the right to ask you to leave the Event. You will not receive a refund if you are denied entry to, or if you are asked to leave, the Event.

  1. You acknowledge and agree that your attendance at the Event is voluntary and at your own risk and that K18 is not responsible for any personal injury sustained by you, for loss or damage to your personal property, or for your loss of income.

  1. Your information. Our privacy policy can be found through this link: https://www.k18hairpro.com/pages/privacy-policy. Our website Terms of Service can be found here: https://www.k18hairpro.com/pages/terms-of-service. By attending the event, you acknowledge and agree that you have reviewed and understand our privacy policy and our website terms of service.

  1. Recordings; Intellectual Property. K18 may take Event photographs or make Event video or audio recordings that include your image or your voice (collectively, “Event Recordings”). By participating in the Event, you grant to K18, its affiliates and its sublicensees the right to record, film, photograph, and capture your image and voice in any media at the Event, and an irrevocable, nonexclusive, perpetual, worldwide, royalty-free, freely sublicensable license to use, reproduce, modify, distribute and translate your image or voice contained in the Event Recordings for any K18-related business purposes at any time and in any form of media. Further, you acknowledge and agree that you waive any moral rights you may have in the Event Recordings and that you have no right to approve or disapprove our usage of such Event Recordings.

You acknowledge that K18 owns “Intellectual Property,” including, but not limited to, all marks (corporate name, trade name, logo, trademark, service mark, trade dress, domain name, or the like, whether registered or unregistered), and any rights attendant thereto (e.g., copyrights, trade secrets, trademarks, trade names, patents, rights in inventions, rights in designs, rights in logos and trade dress, “moral rights,” rights in mask works, rights of personality, publicity or privacy, and any other intellectual property and proprietary rights), in K18, including, but not limited to, the K18 brand, K18 products, and K18 digital (including its social media channels), and the exclusive right to license and enforce its intellectual property. Nothing herein grants to you any rights or interest, and you have no rights or interest, in K18’s Intellectual Property. For any imagery (photos or video recordings) that you take or obtain at the Event (“Event Imagery”), you acknowledge and agree that you may only use such Event Imagery for your personal use – i.e., sharing with friends and family; displaying on personal websites (as long as the website does not sell any product or service, does not having ads run on or beside such Event Imagery, and does not purport or appear to be an official website of the Event or K18); or displaying on social networking websites, such as Instagram, TikTok and Facebook (as long as the display of the Event Imagery on these sites is not commercial or promotional in any manner, does not having ads run on or beside such Event Imagery, and the social media account is not affiliated with any commercial enterprise).You further acknowledge and agree that you may not make any use of Event Imagery that is not personal use without prior written permission from K18, and that you have no right to sell, transfer, license, sublicense, or give Event Imagery to any other party, except for personal use, in which case you agree to inform anyone to whom Event Imagery is given that it can only be used for personal use.

  1. Event Changes. Speakers or presenters, the timing of Event segments, or the venue for the Event may change without prior notice at K18’s sole discretion. Further, while the Event is planned to proceed come rain or shine, if circumstances beyond K18’s control (e.g., severe weather, pandemic, government orders, war, strike, riot, crime, acts of God, ) make it, in K18’s sole discretion, infeasible or unsafe to proceed on the originally scheduled date or at the originally planned venue, K18 maintains the right to reschedule, move, or cancel the Event. In such case, K18 reserves the right, but not the obligation, to issue refunds. Should K18 issue a refund under this Section 6, K18 will work with Eventbrite to issue your refund or, if applicable, will provide any necessary information for you to request a refund through the Eventbrite platform; however, K18 is not responsible for service fees charged by Eventbrite. In all cases except Event cancellation, K18 reserves the right to resell your ticket to a third party.

  1. Limitations of Liability. In no event shall K18, its affiliates, and its licensees or sublicensees be liable to you under any cause of action or any theory of liability for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenues, customers, opportunities, or goodwill.

  1. Release of Claims. In consideration of your being allowed to register for, and participate in the Event, you, on behalf of yourself, your heirs, dependents, personal representatives, assigns, and anyone else who might make a claim on your behalf or as a result of your death or injury, hereby release K18 and its affiliates, and their respective directors, officers, employees, contractors, representatives, agents, successors, and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and costs) that you may have now or in the future associated in any way with the Event or the Event Recordings, including loss of life, illness, including but not limited to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the Event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence or willful misconduct of K18.

  1. No endorsement. The views expressed by any Event attendee, speaker, exhibitor, or sponsor are not necessarily those of K18. All attendees, speakers, exhibitors, and sponsors are solely responsible for the content of all individual or corporate presentations, marketing collateral, and/or advertising.

  1. Entire Agreement. These Terms and Conditions supersede all prior discussions and writings and constitute the entire agreement between you and K18 with respect to the subject matter hereof. No waiver or modification or assignment of these Terms and Conditions will be binding upon K18 unless made in writing and signed by a duly authorized representative of K18; however, K18 may modify or amend these Terms and Conditions at any time by posting an updated version to k18hairpro.com. The failure or delay in enforcing any right will not be deemed a waiver. These Terms and Conditions do not create any third-party beneficiary rights in any individual or entity that is not a party to them. In the event that any of the provisions of these Terms and Conditions shall be held by a court or other tribunal of competent jurisdiction to be illegal, invalid or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.
